Where the Chief Executive or other public officers on his behalf enters into a contract, only the office held by the Chief Executive or the public officer need be named and the Chief Executive or public officer shall be deemed to be a party to the contract as if they were a corporation sole with perpetual succession: Interpretation and General Clauses Ordinance (Cap 1) s 59. 2. A participant in a transaction or in legal action or proceeding. 3. In relation to a legal proceeding, a party served with a notice of or attending any proceeding, although not named on the record: High Court Ordinance (Cap 4) s 2; District Court Ordinance (Cap 336) s 2. 4. In relation to an appeal to the Court of Appeal, a party directly affected by the appeal includes a person or entity served in the proceedings in the court below whether he appeared or not: Gillooly v Gillooly [1950] 2 All ER 1118, WN 524. In relation to appeals against a magistrate, a ‘party’ includes the Hong Kong SAR and any person aggrieved by a finding of a Magistrate: Magistrates Ordinance (Cap 227) s 2. 5. In relation to customary marriages, a party does not include a concubine (tsip) but includes a husband and the principle wife, whether such wife is a kit fat or a tin fong wife: Marriage Reform Ordinance (Cap 178) s 2.
