| 释义 | 無人認領的款項 Money lodged in court but is not paid out or claimed. When any sum of money remains unclaimed in the court for a period of five years, the Chief Justice may, on application by the Registrar of the High Court, order such sum to be transferred to the general revenue of Hong Kong: High Court Suitors’ Funds Rules (Cap 4B) r 23(1); District Court Ordinance (Cap 336) s 18(1). Where a trustee, other than the Official Receiver, under any bankruptcy; or a nominee under any voluntary arrangement, pursuant to the Bankruptcy Ordinance has under his control any unclaimed dividend which has remained unclaimed for more than six months, or any money held in trust by the bankrupt for another person, or where, after making a final dividend, he has in his hands or under his control any unclaimed or undistributed money arising from the property of the bankrupt, he shall forthwith pay it to the Official Receiver who shall carry the same to an account to be termed the Bankruptcy Estate Account. The Official Receiver’s receipt for the money so paid shall be a sufficient discharge to the trustee in respect of it: Bankruptcy Ordinance (Cap 6) s 128(1). All money and securities which remains in the hands of a trust company, as trustee, unclaimed by the person entitled to the same for a period of six years after the time when the same shall have become payable to such person, together with interest, shall be paid by the company into court under and in accordance with s 62: Trustee Ordinance (Cap 29) s 104. 存放在法庭但未予以支出或認領的款項。如任何款項存於法院無人認領達五年，終審法院首席法官可應高等法院司法常務官的申請，命令將該筆款項轉撥入香港政府一般收入內：《高等法院訴訟人儲存金規則》（第4B章）第23(1)條；《區域法院條例》（第336章）第18(1)條。凡任何破產案中的受託人而非破產管理署署長者；或任何自願安排中的代名人，依據《破產條例》控制任何無人申索的攤還債款，而該攤還債款在其控制下超過六個月無人申索，或該受託人依據《破產條例》控制任何由破產人以信託方式為他人持有的款項，或在派發末期攤還債款後，該受託人手上仍有或仍控制從破產人的財產產生的任何無人申索或未予派發的款項，則該受託人須立即將該等款項繳付予破產管理署署長，而破產管理署署長則須將該等款項撥入一個稱為「破產人產業帳戶」的帳戶內。破產管理署署長就如此繳付的款項而發出的收據，即充分解除受託人就該等款項所負的責任：《破產條例》（第6章）第128(1)條。留在身為受託人的信託公司手上的所有款項及證券，如在該等款項及證券須支付予有權享有的人之後六年內仍未被申索（獲具司法管轄權的法院頒令制止付款者除外），則信託公司須將該等款項及證券連同其就該等款項及證券而收取的利息（如有的話），在減去信託公司適當徵收的佣金或其他費用後，根據及按照第62條向法院繳存：《受託人條例》（第29章）第104條。 |
