释义 | 有條件的意圖 A purpose dependent upon a stipulation. A conditional intention will not suffice to constitute the offence of theft: A-G’s References (Nos 1 and 2 of 1979) [1980] QB 180, [1979] 3 WLR 577. If a person takes another one’s property which at that moment was ‘conditional’, that is, if the appropriator intended to see what the articles were and if they were of value then to keep them, the offence of theft had not been committed. On the other hand, if the appropriator intended from the very beginning to keep the articles whether they turned out to be, the appropriator is guilty of theft: Au Lai Yung v R [1976] HKLR 249 (HC); R v Leung Wing Hong [1993] 1 HKC 353, 2 HKCLR 149.
