释义	可予寬宥的殺人 A killing to which the law would ordinarily attach some degree of blame, but which it excuses, such as where the killing is in self-defence or misfortune: R v Semini [1949] 1 All ER 233, 1 KB 405 (CCA). Death by misfortune is a death in the absence of the intent for murder and which is also not manslaughter: Halsbury’s Laws of Hong Kong Vol 9, Criminal Law and Procedure [130.313]. No punishment will be incurred by any person who kills another by misfortune, or in his own defence, or lawfully in any other manner: Offences Against the Person Ordinance (Cap 212) s 8.
