释义 | 租客 1. A term originating in feudal times, referring to a person who held ‘tenure’ of land either from the Crown or a mesne lord. The use of the term in this sense has become much less common over time, although it is still seen in such terms as ‘tenant in common’, ‘joint tenant’, and ‘life tenant’. 2. In modern times, the term is used almost exclusively to refer to a person who holds land under a tenancy from a landlord, whether for a term of years, or under a periodical tenancy, or at will, or at sufferance. The tenant has an exclusive possession of the premises for a certain duration, without which there will be no tenancy at all: Lucky Shoe Reparing and Key Duplication Centre v Best Sharp Development Ltd [1988] HKC 286; So Ho v Chan Chui Yip [1980] 1 HKC 432. A tenant for the purposes of the provisions relating to new tenancies of domestic tenancies in Hong Kong, does not include a Government lessee but includes a subtenant; any government other than the Government of Hong Kong Special Administrative Region; a public body; corporation; and partnership or firm: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 115(1).
