单词 Void
释义 無效
1. Legally non-existent; having no legal effect; lacking the intended legal effect: Brooks v Burns Philip Trustee Co Ltd (1969) 121 CLR 432. An act, decision, deed or transaction that is void cannot be enforced or relied upon. Whether an act, decision, deed or transaction such as a contract or a marriage, is void or voidable, depends on the principles applied in the particular area of law. ‘Void’ is sometimes treated as synonymous with ‘voidable’, or ‘voidable at the election of the party for whose benefit a legal rule makes the transaction void’. 2. In administrative law, if an act, a decision, an order or an instrument is invalid, it should in principle be void for all purposes. However, the invalidity may be cured by having recourse to an appeal: Lloyd v McMahon [1987] AC 625, [1987] 1 All ER 1118; Calvin v Carr [1980] AC 574, [1979] 2 All ER 440, 2 WLR 755. See also Void ab initio; Voidable.
