Prolongation cost |
In building law, extra expense resulting from an extension to the period for performing construction works. Most contracts for building or engineering work entitle the contractor to an extension of time for completion if events occur which might, if prolonged, frustrate the contract. Valuing delay by calculating a daily rate for time-related preliminaries might well result in a significant under-reimbursement to the contractor, therefore prolongation costs should be calculated on a cost or loss and expense basis: A-G v Shimizu Corp (Formerly known as Shimizu Construction Co Ltd) (HCMP 1169, 2892, 2893, 2895/95, unreported). Where the employer’s conduct causes delay, the contractor is similarly entitled to the extra cost which he would not have incurred but for the delay: Lawson v Wallasey Local Board (1883) 11 QBD 229 See also Acceleration cost; Breach of contract; Building contract; Contractor; Delay. 另見 Acceleration cost; Breach of contract; Building contract; Contractor; Delay。 |
