| 释义 | 劃分性文字 Words in a grant that displace the common law presumption in favour of joint tenancies by showing that the grantees are to take distinct undivided shares. Expressions which have been held to be words of severance include ‘in equal shares’, ‘equally’, and ‘to be divided between’. In special cases, notwithstanding the absence of words of severance, a court of equity would declare that there was a tenancy in common in equity: Siu Chun Wah, Alice v Malahon Credit Co Ltd [1988] 1 HKLR 196, [1987] 2 HKC 79 (CA); Liu Kwok Wah v Chung Hang Fai, Nancy [1989] 2 HKC 259. In Hong Kong, where an instrument is entered into after 1 November 1984, the common presumption of joint tenancies is reversed and co-owners are now presumed to hold as tenants in common even without any words of severance being used: Conveyancing and Property Ordinance (Cap 219) s 9(1); Ho Nga Sheung v Ma Fook Leung [1993] 2 HKC 647.
