释义 | 押記合併 The doctrine that where a person entitled to land acquires a charge over it, the lesser right is ‘merged’ or ceases to exist: Grice v Shaw (1852) 10 Hare 76, 68 ER 845. At law, a merger is conclusively presumed, irrespective of the parties’ intentions. However, in equity, there is no presumption in favour of merger if the parties intended no merger to incur: Watts v Symes (1851) 1 De Gm & G 240, 42 ER 544; Adams v Angell (1877) 5 Ch D 634 (CA). If there is an express or presumed intention in favour of merger, the charge will be extinguished notwithstanding that it is outstanding in a trustee: Astley v Milles (1827) 1 Sim 298.
