Words used to define the interest being disposed of, for example, an easement granted (Wisename Ltd v S-J [1998] 1 HKLRD 71); or words expressing a condition (Pelham-Clinton v Duke of Newcastle [1903] AC 111 (HL)). Technical terms are to be construed in their legal and technical sense when constructing an executed trust. If technical terms were used in the deed, the limitations must be construed as if they were limitations of the legal estate, and thus the absence of appropriate technical words of limitation would be fatal: Re Gillies’ Settlement, Archer v Penney [1917] 2 Ch 205. If, however, in such a deed strict phraseology was not used, the court may give effect to the settlor’s intention, so that, for example, the equitable estate would pass, even though no apt words of limitation were used: Re Bostock’s Settlement, Norrish v Bostock [1921] 2 Ch 469 (CA). 2. Words used to define the reasonable or normal hour for completion to take place, ie within office hour of a solicitor firm: Camberra Investment Ltd v Chan Wai-tak [1989] 1 HKLR 568.
