A bill is payable on demand which is expressed to be payable on demand, or at sight, or on presentment; or in which no time for payment is expressed: Bills of Exchange Ordinance (Cap 19) s 10(1). Where a bill is accepted or indorsed when it is overdue, it will, as regards the acceptor who so accepts and any indorser who so indorses it, be deemed to be a bill payable on demand: s 10(2). An instrument payable on demand is overdue when it appears on its face to have been in circulation for an unreasonable time, which is a question of fact in each case: s 36(3).
凡票據訂明可憑票要求付款、見票即付、出票即付、或沒有訂明付款日期的,即可憑票要求付款:《匯票條例》(第19章)第10(1)條。如匯票逾期而獲承兌或背書,則對承兌人或背書人而言,所承兌或背書的匯票,須當作是憑票要求付款的匯票:第10(2)條。憑票要求付款的票據如票面上顯示該票據已流通了一段不合理的時間,即屬逾期票據。至於何謂一段不合理的時間,乃屬事實問題:第36(3)條。
