| 释义 | 專利 A grant under the Patents Ordinance (Cap 514) conferring upon the grantee exclusive rights during the term of the patent, to exploit, and to authorise other person to exploit, the invention in respect of which it is granted. A patent in Hong Kong may be a standard patent or a short-term patent. The Patents Ordinance provides for the registration as a standard patent which has been registered in a ‘designated patent office’. Patent rights are personal property, and may be assigned, willed, sold, licensed or otherwise dealt with by the patentee: Patents Ordinance (Cap 514) s 50(1)-(3). The subject matter becomes public property when the patent term expires after a maximum of 20 years for standard patent (s 39(1)) and eight years for a short-term patent (s 126(1)).
