Paying bank |
The bank upon which a cheque was drawn. The term was imprecise since a bank could pay a cheque as agent for the bank on which the cheque was drawn. Now referred to as the ‘drawee bank’. Where a customer pays money into his account, the bank obtains title to the money and assumes a contractual liability to repay an equivalent amount to the customer or to his order. At any given time, the bank is liable to repay its customer the amount of the credit balance on the account or, where the bank has a presently exercisable right of set-off, the net balance on one or more account: Paget’s Law of Banking (11th Ed, Butterworths) pp 327-328. See also Drawee bank. |
