A holding of land for a term of years or for a periodic term. In Hong Kong, apart from the land on which the St John’s Cathedral stands, land is alienated only for a term of years by way of Government lease. This form of property is that of chattels real. Originally the term of years did not confer either an estate or an interest in land, and as a result it was not heritable. It did not confer seisin, nor did it originally give a right of recovery of possession. When a leaseholder was dispossessed the law originally gave him only a personal remedy. This is so until the invention of the writ of trespass de ejectionae firmae in the late 15th century, and it gradually was referred to as an estate and allowed the lessor the right to proceed through a real action: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0010], [230.0015], [230.0016].
