释义 | 租契 An instrument which confers at once a right to exclusive possession at a reserved rent for a period that is definite or capable of definition. It includes any agreement for the letting of any premises, whether oral or in writing: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 2. An instrument is usually construed as a lease if it contains word of present demise, for example the word ‘demise’ or ‘let’ is the most usual words of present demise: Barry v Nugent (1782) 3 Doug KB 179; Baxter d Abrahall v Browne (1775) 2 Wm Bl 973. Other words are effectual if they import an immediate letting, for example ‘you shall have a lease’: Maldon’s Case (1584) Cro Eliz 33. The usual contents of a lease by deed are: (1) date; (2) parties’ names and descriptions; (3) consideration; (4) the operative words; (5) the parcels and description of the property demised; (6) the exceptions and reservations: (7) the habendum, meaning the commencement and duration of the term; (8) the reddendum, meaning the amount of rent, and the person to whom, the time at which and the manner in which it is to be paid; (9) tenant’s covenants; (10) landlord’s covenants; and (11) the provisos and conditions: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.094]. ‘Lease’ is to be distinguished from ‘licence’.
