Commencing a prosecution for an offence by filing or presenting an information, charge, or complaint with a magistrate, judge or other authorised person in the manner provided by the particular procedural legislation applicable in the jurisdiction: Magistrates Ordinance (Cap 227) s 26; R v Hill [1988] 2 HKLR 216. Once the information has been received at the office of the clerk to the justices or magistrates, the information will have been laid. No more is required of the prosecutor to launch the intended criminal proceedings: Hill v Anderton [1982] 2 All ER 963 (HL). There is a presumption of regularity that the information has been laid in the proper manner and it was laid on the date asserted in the information: Cheung Kwok Cheung v R [1982] HKLR 126 (CA).
