释义 | 旗國法 In maritime law, the law of the state whose flag is hoisted by a particular ship or vessel. The flag displays the nationality of the vessel: for example, Geneva Convention on the High Seas 1958 arts 4, 5. A ship on the high seas is subject to the exclusive jurisdiction of the law of the flag: art 6 para 1. A party entering a contractual arrangement with the master of a vessel must submit to the law of the flag state for the administration and operation of that contract. It is a principle of law that the master intends the law of the flag state to be applicable to such a contract. While the rights of claimants may be determined by the lex loci or the law of the flag of the ship, all questions of priority of liens or claims are determined in Hong Kong by the lex fori: The Colorado [1923] All ER Rep 532,16 Asp MLC 145, P 102 (CA).
