Leading mark |
A mark used to identify goods comprising cargo. Leading marks are documented on the bill of lading. Under the Hague-Visby Rules 1979, which have been given force of law in Hong Kong under the Bills of Lading and Analogous Shipping Documents Ordinance (Cap 440) s 8, the shipper is entitled to demand the bill of lading showing the leading marks from the carrier. The carrier may refuse to supply the bill of leading unless such marks are stamped or otherwise shown clearly on the goods, or where the carrier has reasonable grounds for suspecting that the leading marks do not accurately represent the goods actually received, or where the carrier has no means of checking the leading marks: Hague-Visby Rules art 3(3). Leading marks noted on the bill of lading are prima facie proof of receipt by the carrier of the goods described: Parsons v New Zealand Shipping Co [1901] 1 KB 548 (CA). Marks that are not material to the identity of the goods or indicate nothing whatever to a buyer as to the nature, quality or quantity of the goods he is buying are not regarded as leading marks: Parsons v New Zealand Shipping Co, supra. See also Bill of lading; Charterer; Goods. 另見 Bill of lading; Charterer; Goods。 |
