A verdict given without the unanimous agreement of all members of the jury. At common law, the verdict of a jury must be unanimous in order to be acceptable: R v Flood (1914) 10 Cr App Rep 227 (CA). That has been altered in Hong Kong by statute and a jury may deliver a majority verdict requiring the agreement of a minimum specified number of jurors: Jury Ordinance (Cap 3) s 24(1). Majority verdict is not permitted when the number of jurors remaining is reduced to five by reason of individual jurors being discharged before rendering the verdict: s 24(3). The court will discharge a jury which cannot reach a majority verdict: s 27. Majority verdict is applicable to murder as for other offences carrying life imprisonment: R v Lai Hon Man [1994] 2 HKC 210. See also Unanimous verdict.
