释义 | Bain訴Fothergill之原則 A common law rule that restricts damages payable by a defendant who, in the absence of fraud or bad faith, is unable to transfer a good title to land: Bain v Fothergill (1874) LR 7 HL 158, [1874-1880] All ER Rep 83. The High Court has held that the rule should not apply in Hong Kong: Roseric Ltd v West River Development (Chan Lau & Wai (A Firm), Third Party) [1993] 2 HKC 404 (HC).
