释义 | 欺詐性處置 A transfer, sale, mortgage, or other dealing with property intended to defraud, defeat or delay creditors: for example Sulanser Co Ltd (in liq) & Anor v China Allied Holdings Ltd & Ors [1999] 2 HKLRD 189. Such disposition will be voidable under the Conveyancing and Property Ordinance (Cap 219) ss 60, 61 unless the property has been disposed of for valuable or good consideration and in good faith to anyone not having, at the time of the disposition, notice of the intention to defraud: for example Honour Finance Co Ltd v Poon TingChau & Anor [1990] 2 HKLR 629 (CA). Thus, a person who is being assigned the property with an intention to defraud creditors will have only a voidable title. A subsequent purchaser from the donee in good faith with no actual or constructive notice of fraud will, however, receive a good title: Sihombing & Wilkinson A Student’s Guide to Hong Kong Conveyancing (1997), ch 5, p 298.
