A principle of international law that the high seas can never be under the sovereignty of any nation state, and that navigation is to be free of all interference whether the vessel is warship or merchant vessel. The principle embraces a number of understandings: in general, no state may exercise jurisdiction over a vessel not bearing the flag of that state; every state may use the high seas for laying submarine cables, oil pipelines, and for scientific purposes; and there is absolute freedom of flight by an aircraft over the high seas: Geneva Convention on the High Sea 1958 art 2.
