释义 | 有爭論的事實 In relation to a criminal trial, the facts relevant to proving the commission of an offence. A distinction can be made between the facts in issue and the facts used as a method of proving the facts in issue. Respect for the adversarial nature of litigation must be balanced against the objective of determining the facts in issue at trial. Hence it is probably justified in pre-trial proceedings for complex commercial crimes to require the defence, as a matter of procedure, to indicate in response to a prosecution statement containing an account of the facts and inferences on which it proposed to take issue with the prosecution: Complex Commercial Crimes Ordinance (Cap 394) s 16(1)(a).
