| 释义 | 合法權限 1.A person or organisation sanctioned by law, having the power or right to enforce obedience. 2. A right or power in a person granted by law. It extends to, and denotes, any permission which may lawfully be given by a public officer or department or by a private person: Summary Offences Ordinance (Cap 228) s 2. It is a defence to a number of statutory offences to show that the accused acted with lawful authority. Where the accused relies on ‘lawful authority’ as a defence, the onus is on the accused to prove he has lawful authority, for example the offence of possession of offensive weapon under the Public Order Ordinance (Cap 245) s 33(1). Whether given facts are capable of constituting lawful authority or reasonable excuse is a matter of law for the judge: Dickins v Gill [1896] 2 QB 310 (DC).
