| 释义 | 國家法 A body of law prescribed by the supreme controlling authority of a country, having binding legal force and sanctions or legal consequences for non-observance. Under the preamble of the Basic Law, the Hong Kong SAR was established under the principle of ‘one country, two systems’ under the Constitution of the People’s Republic of China art 31. Under this system, national laws shall not be applicable in the Hong Kong SAR except for those listed in Annex III of the Basic Law (Article 18) and the laws previously in force shall be maintained except for any that contravene the Basic Law and subject to any amendments of the local legislature. See also Basic Law; Municipal law; National law. 國家的最高監管機構規定的一套法律，它具法律約束力及產生法律制裁，或對不遵守者產生法律後果。根據《基本法》序言，香港特別行政區乃根據中華人民共和國憲法第三十一條的規定，並按照“一個國家，兩種制度”的方針設立。在這制度下，全國性法律除下述外，均不適用於香港，適用香港的為《基本法》附件III(第18條)列述的法律，及除抵觸（以前已生效的抵觸《基本法》之法律，在當地立法機關修訂後，須予保留）。另見 Basic Law; Municipal law; National law。 |
