释义 | 貨物完整無損的提單 A bill of lading that contains an unqualified statement that the goods were shipped in good order and condition: Restitution Steamship Co v Sir John Pirie & Co (1889) 61 LT 330. Most bills of lading contain a pre-printed clause that the goods were ‘shipped in apparent good order and condition’ and are considered clean if the bill contains nothing in the margin qualifying those words: Albert Francis Bailey v United Chinese Bank Ltd [1953] HKLR 102. A bill of lading that contains a notation that the goods became damaged after they were loaded on board does not render the bill unclean: The Galatia [1980] 1 Lloyd’s Rep 453. A clean bill of lading is usually required where the shipment is financed by a documentary credit governed by the Uniform Customs and Practice for Documentary Credits 500 (1993 Ed) art 32.
