Tenancy of premises let as dwelling: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 115(1). Where there is insufficient evidence as to whether premises were or were not let as dwelling, the nature of the tenancy is determined by the primary user of the premises: s 115A(1)(c). It is also relevant to consider the type of business and the hours or intensity of the business and domestic users: Yu Kuk v Cmr of Rating and Valuation (LDLA 7/85, unreported). Since it is a policy of the Landlord and Tenant (Consolidation) Ordinance to protect tenants, if domestic and other (ie business) users are equally balanced, the scales may be tilted in favour of the domestic side: Wong Yip v Cmr of Rating and Valuation [1986] HKLR 337 (CA). Where a dispute arises as to whether a tenancy is domestic, the landlord or the tenant may, if primary user is relevant to the dispute, apply in the specified form to the Commissioner of Rating and Valuation for his certificate as to the primary user of the premises and must specify in the form the nature of the dispute: s 115A(3).
