| 释义 | 不完整的票據 Partial or unfinished instruments, documents or enactments. Instruments which are required to be recorded and registered are described prior to registration as inchoate, meaning they are valid only between the parties and those persons having notice of the instrument. A person in possession of an incomplete instrument has prima facie authority to fill it up in any way he thinks fit, but it must be filled up within a reasonable time if it is to be enforceable against a person who became a party to it before it was filled up, and strictly in accordance with the authority given: Bills of Exchange Ordinance (Cap 19) s 20(1). If an inchoate instrument after completion is negotiated to a holder in due course, it will be valid and effectual for all purposes in his hands, and he may enforce it: s 20(2). 局部完成或未完成的票據、文件或成文法則。須予以記錄及註冊的票據在註冊前被視為不完整，即只對匯票各方及知悉該票據的人有效。管有未完成票據的人有表面授權在票據上按其認為適當的方式填上任何款額，但為使票據可向在其完成前已成為匯票一方的人強制執行，該票據必須在合理時間內嚴格按照所授權力予以填妥：《匯票條例》（第19章）第20(1)條。如不完整的票據在完成後轉讓予當期持有人，則該票據在該當期持有人手中時，就所有目的而言，均屬有效及有作用，而該當期持有人亦可執行該票據：第20(2)條。 |
