释义 | 錯誤或錯誤描述 In land law, falsely or incorrectly describing the physical dimensions of a piece of land: for example Green Park Properties Ltd v Dorku Ltd [2002] 1 HKC 121, 2 HKLRD 400 (CFA); Chan Yiu Kit & Anor v Homeast Development Ltd [2000] 2 HKLRD F13. Compensation for misdescription may be claimed if there is such a clause in the contract: for example Cheng Kwok Fai v Mok Yiu Wah, Peter [1990] 2 HKLR 440. In the case of substantial misdescription the purchaser will not be compelled to take compensation: Flight v Booth (1834) 1 Bing NC 370. However, if the defect which causes misdescription does not substantially alter the nature of the property, the contract would be enforced subject to payment of compensation by the vendor: Halsbury’s Laws of Hong Kong (2001 Reissue) Vol 16, Land [230.0182].
