At common law, the time beginning with the delivery of a deed, not the day on which it is stated to have been made or executed. Delivery may be actual or constructive, and is rebuttably presumed to have occurred after execution: Xenos v Wickham (1867) LR 2 HL 296. A party may be estopped by conduct from proving the date of execution, for example by allowing a later date to be written in: Rudd v Bowles [1912] 2 Ch 60. See also Deed; Delivery; Escrow; Estoppel.
