释义 | 證供的繼續留存 Commencement of an action for a future right to preserve and perpetuate evidence when it is in danger of being lost before the matter to which it related could be made the subject of judicial investigation: Shanahan v Shanahan [1917] 1 IR 57. It is in general essential for the maintenance of the suit that the plaintiff was not able to institute proceedings to have the matter in controversy immediately determined: Brooking v Maudslay, Son and Field (1888) 38 Ch D 636. It is also essential that the matter should not be the subject of an existing action or suit against the plaintiff: Earl Spencer v Peek (1867) LR 3 Eq 415. Witnesses may not be examined to perpetuate testimony unless an action has been begun for the purpose: The Rules of the High Court (Cap 4A) O 39 r 15(1).
