Any river, stream, watercourse, lake, pool or pond, whether natural or artificial or above or below ground, and the bed or channel of any such river, stream, watercourse, lake, pool or pond which is for the time being dry, and includes groundwater and the ground in which groundwater is from time to time found, but excludes a lake, pool or pond, the waters of which do not enter (whether directly or by way of another lake, pool or pond) any river, stream or watercourse or the territorial waters or tidal waters of Hong Kong; and any drain or sewer: Water Pollution Control Ordinance (Cap 358) s 8. Inland waters does not include any waters within the ebb and flow of the tide at ordinary spring tides or the waters of any dock which is directly or (by means of one or more other docks) indirectly, connected with such waters. Merchant Shipping (Collision Damage Liability and Salvage) Ordinance (Cap 508) sch 1 pt 2 para 2(2). 2. Sea waters on the landward side of baselines of a coastal state. Coastal states have absolute territorial control and sovereignty over their inland waters. Foreign states generally enjoy no right to innocent passage through these waters in the absence of a treaty obligation to the contrary. However, a right to innocent passage exists in waters once considered part of the territorial sea, which a state has since enclosed as inland waters using a straight baseline technique: United Nations Convention on the Law of the Sea 1982 art 8.
