In relation to goods, a vice which is an innate, natural or normal quality of the goods.
Insurance - An innate characteristic of goods that causes them to deteriorate as a result of their natural behaviour in the ordinary course of the contemplated voyage, without the intervention of any fortuitous external accident or casualty: T M Noten BV v Harding [1990] 2 Lloyd’s Rep 283 (CA). Anything which by reason of its own inherent qualities is lost without any negligence by anyone: Greenshields, Cowie & Co v Stephens & Sons Ltd [1908] AC 431 (HL). For example, if goods are damaged because they were wet when shipped, the damage is said to be a result of inherent vice: T M Noten BV v Harding, supra. Unless the policy provides otherwise, an insurer is not liable to indemnify an insured for any loss caused by inherent vice: Marine Insurance Ordinance (Cap 329) s 55(2)(c).
