释义 | 旅店主理人的留置權 A lien possessed by an innkeeper, for his charges on all property, even stolen property, brought by his guest to the inn. A hotel proprietor, as an innkeeper, has a lien for a guest’s unpaid bill over all goods (other than those excluded by statute) deposited by the guest wherever they are situated at the inn, whether or not the goods are specifically deposited with the innkeeper for safe keeping, until the unpaid bill is paid: Williams v Linnitt [1951] 1 All ER 278, 1 KB 565 (CA); Halsbury’s Laws of Hong Kong, Vol 11, Entertainment, Hotels, Sport and Tourism [155.118]. The lien exists only as long as the innkeeper retains possession or control of the goods: Legg v Evans (1840) 6 M & W 36; Orchard v Rackstraw (1850) 9 CB 698. The innkeeper is not, however, entitled to detain the guest himself, nor to take clothes from his person: Sunbolf v Alford (1838) 3 M&W 248. The lien does not arise until the debt is incurred: Wright v Anderson [1909] 1 KB 209. An innkeeper does not have a lien in respect of charges arising from taking care of goods for any period in which the person has ceased to be a guest: Halsbury’s Laws of Hong Kong, Vol 11, Entertainment, Hotels, Sport and Tourism [155.118].
