| 释义 | 不能實行 In relation to an arbitration agreement, the state of having no legal effect, although continuing to exist. The term originates from the state where the arbitration agreement has ceased to have effect. Parties to the arbitration agreement might have, either explicitly or implicitly, revoked to have the dispute arbitrated is one of the possible reasons that the arbitration ceased to have effect: Luck-Goldstar International (HK) Ltd v Ng Moo Kee Engineering Ltd [1993] 1 HKC 404 (HC). Under the UNCITRAL Model Law on International Arbitration Art 8(1) and the Arbitration Ordinance (Cap 341), a court is mandatory to stay an action brought before it and to refer it to arbitration upon the request made before submitting the first statement on substance of dispute by a party if the parties have agreed to have their dispute resolved by way of arbitration, unless the agreement is no longer operative: Tai Hing Cotton Mill Ltd v Glencore Grain Rotterdam BV & Anor [1996] 1 HKC 363 (CA). It would be stretching the wording of Art 8(1) of UNCITRAL Model Law too much if the contract which gives parties’ right to refer a dispute to arbitrate is to be treated inoperative because the parties choose not to exercise the right: China Merchants Heavy Industry Co Ltd v JGC Corp [2001] 3 HKC 580 (CA).
