释义 | 相對可能性的衡量 Comparison of competing probabilities in order to decide the existence of which one is more probable than not. It is the standard of proof in civil cases. However, the degree of proof required in this formula varies in different allegations in civil cases: Halsbury’s Laws of Hong Kong, Vol 12, Evidence [175.019]. For example, allegations of fraud, crime or professional negligence require a higher degree of proof. It also applies in criminal cases whenever the onus of proof is on the defendant to prove a particular fact in issue: R v Dunbar [1957] 2 All ER 737, 41 Cr App Rep 182, [1958] 1 QB 1 (CCA); or to rebut a statutory presumption: Kwan Ping Bong & Anor v R [1979] HKLR 1 (PC); R v Lee Wai Keung, Dickie & Anor [1991] 1 HKLR 585 (CA).
