释义 | 市場聲譽 In intellectual property law, the extent to which the business of a trader is known by current and prospective customers. It has always been a fundamental requirement of passing off that the plaintiff establishes that he has a reputation residing in good will which exists in the jurisdiction: Oertli AG v Bowman (London) Ltd [1957] RPC 388. For passing off, an overseas plaintiff need not show actual business activity in the jurisdiction but must establish the presence of customers in the jurisdiction: Pete Waterman Ltd v CBS United Kingdom Ltd [1994] EMLR 27; Tan-Ichi Co Ltd v Jancar Ltd [1990] FSR 151. See also Distinctiveness; Market; Passing off. Trade and commerce - In trade practices, with reference to misleading or deceptive conduct, the public reputation of a particular trader. Damages may, it seems, be awarded for injury to a trader’s reputation caused by an illegal seizure of his goods under a false and pretended claim of right: Brewer v Dew (1843) 11 M & W 625.
