| 释义 | 受寄人責任 The duties of a person in possession of the goods of another, such as to redeliver the bailed goods to the bailor on termination of the bailment or in accordance with the bailor’s instructions to take reasonable care of the bailed goods; and to carry out the purpose and terms of bailment: He-ro Chemicals Ltd v Jeuro Container Transport (HK) Ltd & Anor [1993] 2 HKC 368 (HC). A bailee or sub-bailee must exercise reasonable care to avoid the loss or damage to the goods bailed or sub-bailed. A bailee is liable if he negligently allows the article to be stolen, whether the theft is committed by a stranger or servant or agent. A bailee is also vicariously liable for such a theft, where the bailee had entrusted a servant or agent with safe custody of the article: Morris v CW Martin & Sons Ltd [1965] 2 All ER 725, [1966] 1 QB 716 (CA); Bewise Motors Co Ltd v Hoi Kong Container Services Ltd [1997-98] 1 HKCFAR 256, [1998] 4 HKC 377 (CFA).
