释义 | 法律概念 A term that has a specific legal meaning and not generally used outside legal institutions, for example locus standi (standing), ratio decidendi (rationale of judgment), stare decisis (precedent), and obiter dicta (said by the way). The Swedish jurist Axel HagerstrÖm argued that legal concepts, particularly those derived from Roman law, have no real content but rather fulfil a magical function in judicial interpretation that has the effect of glossing over complexities in legal system.
