释义 | 受寄人不容反悔 Estoppel of a bailor’s claim that the bailee breached his or her duty to the bailor that arises where the bailee can show that the bailed goods were delivered to the true owner. Where a bailee receives the goods from the owner (the bailor), the bailee is estopped from denying the title of the bailor. Where the bailee attorns the goods to a person (the attornee), he is estopped from denying the title of the attornee. The estoppel will cease if the bailor loses his/her title by eviction by title paramount unless there is a special contract between the bailor and bailee or the bailee is to be blamed for the eviction: Halsbury’s Laws of England (4th Ed reissue) Vol 2, para 1882. The bailee is entitled to show that a third party has a better right than the bailor in all or part of the bailor’s interest or the right in which the bailor sues and any rule of law to the contrary is abolished. However there is no equivalent provision in HK abolishing the common law rule.
