释义 | 業權調查 Inquiries into the extent and validity of the property rights that a person claims to hold in real or personal property. The transaction that usually involves the most extensive investigation of title is the purchase of real property, in which case the investigation is made by the purchaser (usually by the purchaser’s solicitors) with the object of ensuring that the vendor does actually hold the title which he or she has promised in the contract of sale to transfer to the purchaser. Another of the more usual transactions which involve investigation of title is acceptance by a lender of a mortgage over property to secure a loan. Under the Hong Kong and English general law conveyancing system, the doctrine of constructive notice deems a person who investigated a title to be aware of matters which he or she should have found, as well as those matters actually examined (including those matters which do not manifest on the title deeds): Wong Chim Ying v Cheng Kam Wing [1990] 1 HKC 481, 2 HKLR 111 (HC). The Registration of Title system in Hong Kong generally provides that a person dealing with the registered owner is not affected by notice of unregistered interests, except in the case of fraud or where the person so dealing has some equitable obligation to the other party involved. The purchaser is entitled to require the vendor to produce either the original documents of the title deed or a certified copy of these to enable the purchaser to conduct appropriate inquiries: Conveyancing and Property Ordinance (Cap 219) s 13.
