释义 | 招標 An invitation to treat with respect to a contract which may ultimately be entered into by the parties. An invitation to tender is not, prima facie (Lobley Co Ltd v Tsang Yuk Kiu [1997] 1 HKLRD 863), an offer to sell to the person making the highest tender. Normally, the actual tender will amount to an offer. It follows that in the usual case, acceptance of such a tender concludes a binding contract: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.030]. Where the invitation to tender requires the tender to remain in effect for a period of time, it may not be withdrawn before expiration of this period: City Polytechnic of Hong Kong v Blue Cross (Asia Pacific) Insurance Ltd [1994] 3 HKC 423 (HC). In such cases there is an implied obligation to consider all conforming tenders and failure to do so will be a breach of contract: Blackpool and Fylde Aero Clud Ltd v Blackpool Borough Council [1990] 2 All ER 25, 1 WLR 1195 (CA).
