The extension of the time prescribed by the rules of court, court order or direction, for the performance of a procedural act through the consent of the parties involved in the action. The period within which a person is required by the Rules of High Court, or any order or direction, to serve, file or amend any pleading or other document may be extended by consent given in writing without an order of the court being made for that purpose: The Rules of the High Court (Cap 4A) O 3 r 5(3). Although the rule requires that the consent should be given in writing, in practice solicitors frequently agree to extensions of time otherwise than in writing. Moreover solicitors often consent to the extension of time for the doing of acts other than those specified in this rule. The parties may agree as to new time limits which will not involve the date of trial being postponed, and if they reach such an agreement they can ordinarily expect the court to give effect to that agreement and it is not necessary to make a separate application for that purpose: Mobil Petroleum Co Inc v Registrar of Trade Marks [2000] 4 HKC 670, 1 HKLRD 225.
