| 释义 | 保留地役權 A method of creating an easement by reserving it from land to be transferred to another, so that it burdens the land transferred and benefits other land retained by the transferor. The reservation may be expressed or implied: Nield, Hong Kong Land Law (2nd Ed, Longman) pp 325, 335. A reservation of an easement is effectual to give legal effect to the reservation without execution of the assignment by the purchaser: Conveyancing and Property Ordinance (Cap 219) ss 16, 24; Goodtex Land Co Ltd v Lung Kwong Emporium Co Ltd [1993] 1 HKC 645, [1992-93] CPR 452. The subject matter of the reservation is not something which was in being immediately before the assignment, but is newly created or reserved out of the land upon the execution of the deed: Jones v Consolidated Anthracite Collieries Ltd [1916] 1 KB 123. An easement, theoretically, cannot be made the subject matter either of a reservation, because an easement is not something issuing out of the thing granted: St Edmundsbury and Ipswich Diocesan Board of Finance v Clark (No 2) [1975] 1 All ER 772, 1 WLR 468 (CA). A reservation strictly is a regrant by the grantee to the grantor: St Edmundsbury and Ipswich Diocesan Board of Finance v Clark (No 2), supra.
