| 释义 | 居留地測試 A test used to establish whether a person or body corporate is ordinarily resident in Hong Kong. In relation to a person, it depends on whether that person lands in Hong Kong lawfully and remains lawfully, if so, he or she is ordinarily resident in Hong Kong: Re Ho Wing Man [1985] 2 HKC 509. It is no more than a question of fact: Lau San Ching v Apollonia Liu (1995) 5 HKPLR 23. Proof of ordinary residence is ultimately a question of fact depending more upon the evidence or matters susceptible to objective proof than upon evidence of state of mind: Director of Immigration v Ng Shun Loi [1987] HKLR 798. It also depends whether that person is habitually and normally resident in Hong Kong, apart from temporary or occasional absences of long or short duration: In relation to a body corporate, it is generally based on the place of central management and control: Unit Construction Co Ltd v Bullock (Inspector of Taxes) [1960] AC 351, [1959] 3 All ER 831 (HL).
