Simple contract |
Contracts which are not contracts of record or contracts under seal. Consideration is an essential element of a simple contract. A contract upon which the obligation arises is neither ascertained by matter of record, nor yet by deed or special instrument, but by mere oral evidence, the most simple if any; or by notes unsealed, which are capable of more easy proof, and therefore only better than a verbal promise: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.013]. Simple contracts may be express or implied, or partly express and partly implied. See also Consideration; Formal contract; Simple contract debt; Special contract. 另見 Consideration; Formal contract; Simple contract debt; Special contract。 |
