释义 | 行為的效用 In the law of negligence, the purpose underlying an act; the object to be achieved from one’s action. The utility of a defendant’s conduct must be balanced against the risk of harm to the plaintiff in determining the standard of care required of the defendant: Walker v Northumberland CC [1995] 1 All ER 737, ICR 702. For example, where the defendant’s conduct serves a social purpose, as in the case of an attempt to save life and limb, it may justify a risk which he or she is taking and lower the standard of care expected of him or her: Daborn v Bath Tramways [1946] 2 All ER 333; Watt v Hertfordshire CC [1954] 1 WLR 835.
