The use of something which is not owned by the person using it; the exercise of a power by a person who is not authorised to do so. For example, the appeal court will not usurp the function of the trial judge, such as the finding of facts: Wilson Communications Ltd v Fordease Ltd (CACV 143/2003, unreported). It is no part of a judge’s duties to usurp the functions of the jury: R v Kong Chi Keung & Ors (CACC 435/85, unreported). The court has no power to fill in a gap in a statute, even if it thought that the legislature would itself have filled it; any attempt to repair the omission by the court would usurp the function vested in the legislature, unless a condition was fulfilled: R v Wingkason Brothers Co Ltd [1990] 2 HKC 57. The power to appoint the Official Receiver cannot be exercised by the court, for to do so would tantamount to a usurpation of the power expressly reserved for the Chief Executive: The Official Receiver v Tan Cher Sia, Edward (HCB 69/92, HCB 71/92, unreported).
