A testamentary declaration made orally or in writing by a privileged testator where the formalities of making a will (such as writing, signature, witnesses) are waived in the circumstances. Any person being in actual naval, military or air force service and any mariner or seaman being at sea may, by will, dispose of any property, exercise any power of appointment, or appoint a person as guardian of his infant children by will, without complying with any of the usual formalities either as regards writing, or, if in writing, as regards execution: Wills Ordinance (Cap 30) s 6. A privileged will is proved by affidavit showing that the testator when he made it was in actual military service or at sea, as the case may be, and that he was domiciled in Hong Kong: Halsbury’s Laws of Hong Kong, Vol 27, Wills, Probate, Administration and Succession [425.512]. Whether or not the facts give rise to a privileged will depends on the relevant circumstances: Pang Yiu Hung Robert v Cmr of Police [2002] 4 HKC 579. See also Nuncupative will; Privileged testator.
