| 释义 | 雙重遺囑認證 Where a will nominates several executors but only some apply for a grant of probate, the grant issued is made with leave reserved to the others to come in and prove the will subsequently. When an executor to whom power has been reserved later applies for probate, the grant of probate obtained is known as double probate. The earlier grant continues to be operative and the two probates run concurrently. Double probate is a second grant of probate and is general in terms, as opposed to a limited probate which is limited in relation to property or duration or to a cessate grant of probate which follows on an earlier limited grant that has expired.
